These terms and conditions (“terms”) set out the terms on which Escreen (“Escreen”, “Company”, “us”, “we”, “our”) provide you (“you”, “your”, “customer”, “reseller”, “partner”) with access to the Escreen digital signage solution (“service”) at www.escreen.com (“website”) or any Escreen app available through our official channels.
Please read these terms carefully and ensure that you have understood them. Escreen and customer are hereinafter collectively referred to as “Parties” and individually as a “Party”. By using our service, you warrant that you understand and accept these terms. If you are accepting these terms on behalf of your employer or acting as an employee, you warrant that you are authorized to enter into legally binding contracts on behalf of your employer. The same rights, limitations, and restrictions apply to your employer.
You agree that these terms are enforceable as if they were a written negotiated agreement signed by your employer. If you do not agree to these terms, please cease use of the service immediately. You are advised to print and retain a copy of these terms for your future reference.
1. Definitions
- Digital Host Site(s): The physical location/space provided by the Advertiser / Client / Customer for installing/setting up the Solution, which includes display screen, digital signage media player & internet connectivity.
- Advertisement(s): The promotional message/communication of Advertisers that is displayed at identified Digital Host Site(s) using the Solution.
- Advertiser(s): A Person that pays the Advertising Fees in exchange for display of their Advertisement(s) at identified Digital Host Sites.
- Technology Cost: The Subscription fees or one-time setup fee paid by the Advertiser / Client / Customer / Partner / for using the Solution at the Digital Host Site(s). It may be modified from time to time at the sole discretion of Escreen.
- Billing Period: The period you are billed for, usually a month.
- Contract: The contract between Escreen and the customer.
- Content: Any and all data, files, documents, multimedia files, third-party links, images, videos, and any other information or material whatsoever (in any format) submitted by the customer.
- Fee: The monthly subscription fee per display payable by the customer for use of our services as specified on https://escreen.io/pricing/ or otherwise agreed between Escreen and the customer.
- Hardware: Your computer, laptop, signage player or other device used to access and use the Service.
- White Label Reseller: Similar to “Reseller” who purchases bulk license, subscription or associated hardware from us with the intention of selling them rather than consuming or using them by adding their own branding.
- Intellectual Property: All proprietary inventions (whether patentable or non-patentable), improvements, patents, trademarks (registered or not), service marks, logos, trade names, copyrights (registered or not), source code, trade secrets, and other proprietary rights.
- Intellectual Property (IP) Rights: All legal and economic rights in and to the Intellectual Property, whether registered or not, anywhere in the world.
- Login Details: A unique username and password required for a customer to access Escreen Digital Signage at www.escreen.com.
- Minimum Requirements: Any minimum specifications required for the customer’s Hardware in order for the customer to use the features and functionality of Escreen Digital Signage, as may be specified on www.escreen.com from time to time.
- Network: The electronic communications network used by us to provide a service to the customer.
- Purpose: To use, copy, compress, modify and transmit in order to provide the customer with the service and perform our obligations under these terms.
- Screen/Display: Any television, monitor or other device supported by our service which the customer has claimed.
- Use: Having access to our service for the customer’s organization’s own internal business purposes only.
- User or Person: Any individual employee of the customer or entity that has been permitted to use the service and who has been given the login details.
2. About Escreen Digital Signage and Our Service
The service and www.escreen.com are owned and managed by Escreen, a SaaS-based company from Surat; having its registered address at 406-409, Exiito Hub, Surat, GJ, IN – 395005. Escreen is engaged in developing cloud-based digital signage software for building media networks for advertisements and communications (“Escreen Technology”). The service is intended to be used for commercial purposes. 3. Registration
In order to access and use our service, you shall be required to register using the online registration form made available to you on our Website. By completing the online registration form, you consent to us conducting verification and security procedures in respect of the information provided in such online registration form. Upon completion and submission of the online registration form by you on www.escreen.com, you shall be sent an email confirming your registration. You hereby warrant that the information provided by you is true, accurate, and correct. You further warrant that you shall promptly notify us in the event of any changes to such information provided. You shall keep any login details confidential and secure. Without prejudice to our other rights and remedies, we reserve the right to promptly disable your login details and suspend your access to our service if we have any reason to believe that any user has breached any of the provisions set out herein. Please don’t sign up with false information; if any of your contact details change, keep your information updated. If we suspect someone has broken into your account, we may suspend it and get in touch with you.
4. Representations, Warranties, and Responsibilities of Escreen
Escreen will provide the Digital Signage Technology through which the Advertisement(s)/visual content(s) will be displayed through the Solution at identified Digital Host Sites identified by customer. Escreen will provide a pre-configured signage media player (which should be procured by customer as per the pricing mentioned on the site or mutually agreed pricing) for seamless deployment. The customer has to ensure internet connectivity as per the specification provided or recommended by Escreen. Escreen will provide remote support and testing services for installation, configuration and integration of Escreen Technology with the displays/equipment at the Digital Host Site to ensure that the Solution is fully operational. This service may vary as per the subscription package subscribed by the customer. Escreen will provide remote operation and maintenance support for resolving any technical issues related to Escreen Technology. This service may vary as per the subscription package subscribed by the customer. Escreen represents and warrants that, to the best of its knowledge, Escreen Technology does not infringe the IP Rights of any third party.
5. Formation & Termination Of Your Contract
You must be at least 18 years of age to use our systems as we collect personally identifiable information. Your contract with us shall commence on the date we send your confirmation email. Your contract shall continue unless terminated and shall automatically renew for further recurring periods of one (1) month (each a “Billing period”) unless terminated by you or us in accordance with these Terms. You may terminate your Contract with us at any time by providing notice in writing or by e-mail sent to the postal or e-mail address as available at clause 18 / our website. We may give you notice to terminate your contract and your use of our service at any time. We may suspend or terminate your access and use of our service immediately upon notice to you in the event that:
- Third-party services and network providers cease to make the third-party service or network available to us.
- You fail to comply with one or more of these Terms.
- We believe that there has been fraudulent use, misuse or abuse of features and functionalities of the Service (in whole or in part).
- We believe that you have provided us with any false, inaccurate or misleading information.
Upon termination of your contract, your access to www.escreen.com and our service shall cease and any content will no longer be accessible through our service. We may retain copies of your content and/or other data (including any user’s data) made available through our service for auditing and/or tax purposes or as required by us to comply with applicable law.
6. Access To The Service And Support
In consideration for payment of the service fees, we hereby grant you a non-exclusive, non-transferable (without a right to sub-license) license to access and use our service for the duration of your contract. You acknowledge that you shall be responsible for all use of our service by users and shall ensure that these terms and conditions are brought to their attention. You shall be liable for breach of these terms by a user as if it were a breach by you.
We shall use reasonable endeavors to make our service available to you at all times but cannot guarantee an uninterrupted or fault-free service. Our ability to provide our service may be impaired by conditions beyond our control. We shall take reasonable action to minimize disruptions caused by such circumstances but acknowledge that some interruptions may not be avoidable.
We use industry-standard security measures to protect against loss, misuse, and alteration of information handled by our service. However, you acknowledge that we cannot guarantee complete security against unauthorized access.
We offer support all weekdays between 10 am – 7 pm Standard Time (IST) for advice on access and use of our service, which comprises
- Fault diagnosis subject to you providing a clear description of any fault requiring support.
- We shall use our reasonable efforts to resolve faults within a reasonable time following receipt of your request.
The support detailed in this clause does not include diagnosis and rectification resulting from
- Use of our service other than in accordance with these terms.
- Faults in your or a third party’s software or hardware.
7. Your Obligations
You agree that you are solely responsible for all activities on www.escreen.com and use of our service, including that of your users. You shall promptly notify us in case of any breach of security or unauthorized use of your login details.
You are responsible for ensuring that any content is not deemed offensive or illegal. You hereby grant us a non-exclusive license to use your content for providing services.
You warrant that you own or have rights to all intellectual property rights in any content submitted. You indemnify us against claims arising from our use of such content.
You agree not to:
- Use login details with intent to impersonate another individual.
- Allow anyone else to use your login details.
8. Data Removal
Escreen provides a transparent and user-friendly policy for data removal to safeguard user privacy and comply with global regulations such as GDPR and CCPA. The request must include your account details (e.g., registered email or username) and specify the data to be removed. Once we receive the request, your identity will be verified through a secure process to protect against unauthorized actions. Eligible data for removal includes personal information, uploaded files, and other related content; however, certain data required by law (such as billing or audit trails) may be retained. Data removal requests are processed within 30 days, and users will be notified if additional time is required. It is important to note that once data is deleted, it is irretrievable, and services dependent on the removed data may be partially or fully affected. Users are encouraged to back up their important data before proceeding with the request, as Escreen is not liable for recovery after deletion. Data associated with active contracts or anonymized, aggregated data used for analytics cannot be deleted. 9. Payment & Renewal
Escreen offers various subscription plans for its services
- Starter: $10 per screen/month; $8 per screen for annual subscribers.
- Teams: $15 per screen/month; $11 per screen for annual subscribers.
- Business: $25 per screen/month; $20 per screen for annual subscribers.
- Enterprise: Custom pricing per screen/month includes single user; additional users at $2/user; includes 4 users; additional screens at $5/user; includes 6 users; additional screens at $6/user.
- Custom Plan: No additional charge; custom branding available.
Please note that all payments are non-refundable.
10. Free Trial Policy for 14 Days
Escreen offers a free trial period for 14 days during which users can access premium features without charge. After 14 days, users must select one of our subscription plans mentioned above to continue using our services.
11. Subscriptions and Payments
By subscribing to one of our plans through our website at https://escreen.io/pricing/, users agree to pay all applicable fees according to their selected plan. Payments will automatically renew at the end of each billing cycle unless canceled prior to renewal.
12. Fees and Payment of Fees
All fees are invoiced based on number of displays as per agreed package plan on www.escreen.com. Fees are invoiced on last day of each month. All fees are non-refundable unless otherwise agreed in writing.
13. Free Account
We offer a 14-day free trial account limited to one (1) display where you can try out our service at no cost. With this account, we reserve rights for modifications without citing reasons.
14. Exclusion of Warranties and Limitation of Liability
You acknowledge that our service is provided “as is” without warranties except those expressly set out herein.
15. Intellectual Property Rights
We own all rights related to our service and reserve all intellectual property rights.
16. Data Protection
You shall ensure compliance with applicable data protection laws regarding your use of our service.
17. Viruses, Hacking and Other Offences
You will not misuse our service nor attempt unauthorized access.
18. Publicity and Marketing
Subject to your prior approval, we may refer to you as our customer in marketing materials.
19. Confidentiality
Each party shall keep confidential all information disclosed about operations or business unless required by law.
20. General
Your contract represents the entire agreement between you and us regarding use of www.escreen.com.
